These Terms and Conditions of Sale (the “T&C”) apply to all orders placed on the website https://evisel-tv.fr/ (the “Website”), operated by EVISEL (SASU), a company registered with the Paris Trade and Companies Register under number 907 756 464, with its registered office located at 231 rue Saint-Honoré, 75001 Paris, France, represented by Brandon William, duly authorized.

These Terms and Conditions govern the sale of:

  • virtual reality headsets and, more generally, physical products offered on the Site;

  • virtual tickets, pay-per-view (PPV) access, live streaming, on-demand viewing, and, more generally, digital content or services accessible primarily through the JUMPR VR app.

The customer acknowledges having read these Terms and Conditions prior to placing any order and accepts them without reservation by checking the box provided for that purpose. The Terms and Conditions must be accessible on an e-commerce site intended for consumers prior to placing an order.

Article 1 – Purpose

These Terms and Conditions set forth the terms under which EVISEL sells its physical products and digital content/services to consumers and, where applicable, business customers.

Article 2 – Products and Services Offered

The products and services offered for sale are those listed on the Website on the date of the order, subject to availability.

These may include, for example:

  • virtual reality headsets;

  • accessories related to the use of virtual reality;

  • virtual tickets granting access to a live event;

  • pay-per-view access to entertainment events;

  • access to live or on-demand digital content via JUMPR VR.

The essential characteristics of each product or service are listed on its product page prior to ordering. Consumers must be able to learn, before the contract is concluded, the essential characteristics of the good or service, as well as the terms of the right of withdrawal and the statutory warranties.

Article 3 – Price

The prices listed on the Website are in euros (€) and include all taxes, unless otherwise stated.

Shipping costs for physical products are displayed before the order is finalized.

EVISEL reserves the right to change its prices at any time, provided that the applicable price is the one displayed at the time the order is confirmed.

Article 4 – Order

The customer selects the product(s) and/or service(s) they wish to purchase, adds them to their cart, and then completes the online checkout process.

Before final confirmation, the customer can review the details of their order and the total price, and correct any errors. The contract is formed upon the customer’s confirmation of the order and its acceptance by EVISEL. The buyer must have the means to identify and correct errors before the order is finalized.

EVISEL reserves the right to refuse or cancel any order for legitimate reasons, including:

  • product unavailability;

  • suspicion of fraud;

  • payment issue;

  • contact information that is clearly incorrect;

  • prior breach of these Terms and Conditions.

Article 5 – Payment

The full amount is due at the time of ordering, unless the Site expressly offers a payment plan.

Payments are made using the payment methods offered at checkout, through secure payment providers.

EVISEL does not store customers' full banking information.

If payment is declined or the transaction fails, the order will not be processed.

Article 6 – Delivery of Physical Products

Physical products are delivered to the address provided by the customer at the time of ordering.

Delivery areas, shipping methods, fees, and estimated delivery times are specified on the Website before the order is confirmed.

The customer is responsible for verifying the accuracy of their shipping information. EVISEL cannot be held liable for any delay or failure to deliver resulting from an incorrect or incomplete address.

Upon receipt, the customer must inspect the condition of the package and the delivered product and report any issues immediately.

Article 7 – Provision of Virtual Tickets and Digital Content

Virtual tickets, pay-per-view access, live access, replays, and other digital content or services are provided in digital form, in accordance with the terms and conditions specified on the Website or in the JUMPR VR app.

Unless otherwise specified, access is personal, non-transferable, non-exclusive, and limited to the customer’s private use.

EVISEL may require that the customer have compatible equipment, a sufficient Internet connection, and, if applicable, a compatible VR headset. EVISEL does not guarantee that the service will function properly if the user’s equipment is inadequate or their Internet connection is insufficient.

Article 8 – Right of withdrawal for physical products

In accordance with the Consumer Code, the consumer has fourteen (14) days from the date of receipt of the goods to exercise their right of withdrawal, without having to provide a reason for their decision.

The customer may exercise this right by sending EVISEL, before the deadline expires, the withdrawal form or any unambiguous statement expressing their intention to withdraw.

The product must be returned in its original condition, complete with all accessories and original packaging, except for any wear and tear resulting from handling other than that necessary to determine the nature, characteristics, and proper functioning of the item.

The customer is responsible for all direct return shipping costs, unless otherwise stated on the Website.

The refund will be issued in accordance with applicable legal requirements upon receipt of the returned item or proof of its shipment.

Article 9 – No Right of Withdrawal or Loss of the Right of Withdrawal for Digital Content and Services Performed Immediately

For virtual tickets, pay-per-view access, live streams, replays, and other digital content not provided on a physical medium, the customer expressly acknowledges and agrees that performance begins immediately upon confirmation of the order or on the date of the event.

Consequently, when the customer has given their express prior consent to immediate access and has expressly acknowledged that they are waiving their right of withdrawal, they no longer have the right of withdrawal for that digital content or service. This is the legal requirement for waiving the right of withdrawal in such cases.

Practical clause to include in the checkout process for tickets/PPV:
“I expressly request the immediate provision of the service / immediate access to the digital content before the expiration of the withdrawal period, and I acknowledge that I am forfeiting my right of withdrawal.”

Article 10 – Cancellation, Refunds, and Event Access

Unless otherwise required by law:

  • A virtual ticket or pay-per-view (PPV) pass purchased for a specific event is non-refundable once access has been activated or the event has begun;

  • In the event of a complete cancellation of an event by EVISEL, the customer may be entitled to a rescheduling, a credit, or a refund, as applicable;

  • In the event of minor changes to the program, schedule, speaker, or content, no automatic refund will be issued, unless otherwise required by law.

In the event of a major technical disruption attributable to EVISEL that prevents access to purchased content, EVISEL may, depending on the circumstances, offer alternative access, a postponement, a credit, or a partial or full refund.

Article 11 – Legal Warranties for Physical Products

Products sold to consumers are covered by the legal warranty of conformity and the warranty against hidden defects under the terms provided by French law.

Under the legal warranty of conformity, consumers may request that the item be repaired or replaced; the issue must be resolved within 30 days of the request. In principle, consumers have two years from the date of delivery of the item to take action.

The consumer may also assert claims under the warranty against hidden defects, in accordance with the provisions of the Civil Code. The pre-contractual information must specify the existence of these statutory warranties and the conditions for exercising them.

Article 12 – Customer Account

You may need to create an account to access certain services.

The customer agrees to provide accurate, up-to-date, and complete information. The customer is responsible for keeping their login credentials confidential.

Any use of the account using the customer’s login credentials is deemed to have been made by the customer, unless there is evidence of fraudulent use not attributable to the customer.

Article 13 – Authorized Use – Prohibitions

The customer agrees to use the Website, the JUMPR VR app, virtual tickets, and digital content in a lawful manner and for their intended purpose.

The following are prohibited, among other things:

  • the unauthorized resale of an access pass or ticket;

  • sharing login credentials;

  • the unauthorized recording, capture, copying, distribution, restreaming, or reproduction of content;

  • any attempt to circumvent technical protection measures;

  • any unauthorized commercial use of the content.

Article 14 – Intellectual Property

All content on the Website, in the JUMPR VR app, and in the distributed content—including text, videos, images, logos, trademarks, interfaces, design, and databases—is protected by intellectual property rights.

No ownership rights are transferred to the customer under these Terms and Conditions. Only a limited, personal, and non-exclusive right of access or use is granted, depending on the nature of the service purchased.

Article 15 – Liability

EVISEL takes reasonable steps to ensure the accessibility of the Site and its services, without guaranteeing continuous or uninterrupted availability.

EVISEL shall not be held liable in the event that:

  • force majeure;

  • due to an outage or failure of Internet networks;

  • incompatibility or malfunction of the customer’s equipment;

  • improper use of products or services;

  • temporary interruption for maintenance or updates.

In any event, EVISEL’s liability, to the extent that it may be incurred, is limited to direct and foreseeable damages, subject to the public policy provisions applicable to consumers.

Article 16 – Personal Data

The procedures for collecting and processing personal data are described in the Privacy Policy available on the Website.

Article 17 – Consumer Mediation

In the event of a dispute, the customer must first submit a written complaint to EVISEL at the following address: [email protected].

If the complaint is not resolved, the consumer may file a complaint with the consumer ombudsman responsible for EVISEL.

The business must include the contact information for the appropriate mediator in its Terms and Conditions and on its website.

Article 18 – Governing Law and Jurisdiction

These Terms and Conditions are governed by French law.

In the event of a dispute, and in the absence of an amicable resolution or mediation, the competent courts shall be determined in accordance with applicable general legal principles.

Article 19 – Amendments to the Terms and Conditions

EVISEL reserves the right to modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect on the date of the order.0
